Terms and
Conditions
These TERMS AND CONDITIONS
of service is made between eWebNet Marketing, hereinafter
called Company, and the person/company ordering a Website
Design Budget Package, hereinafter called Client. By the
Client completing and submitting the online order form, the
Client agrees to these terms and conditions.
The Company may update or
amend these terms and conditions at any time. The Company will
communicate any such updates to Client via email and these
changes will be displayed on this page.
The Company reserve the
right to decline to design / host material that the Company
consider to be unsuitable and to make alterations that Company
consider necessary to maintain the Company high standards. The
Company do not accept or host material of dubious legality.
The Company are not liable
for any losses or problems caused by site errors or omissions,
or failure of material to appear on any specified date, at any
time, or in any specified location.
Payment by Client may be
made by UK Cheque, Credit Card or PayPal. A non-refundable 50%
deposit is required to secure the Companies services to design
and build the web site (taken off final payment) Final payment
is required within seven days after the web site is published.
The Company have the right
to remove the Clients web site for non-payment. The Company
reserves the right to charge daily interest on outstanding
amounts, until payment in full is received by Company, at a
rate equal to 25 per cent above the HSBC Bank Plc base lending
rate as current from time to time whether before or after a
court judgement, interest shall continue to accrue.
The web site programming
code, design, words and graphics remains the property of the
Company until full payment has been made by the Client to the
Company. Until full payment is made the Client may not
download, upload, copy or adapt the programming code, design
or the words and graphic creations developed by Company, this
will be deemed as theft and legal action will be taken.
The Client unconditionally
guarantees that the elements of text, graphics, photos,
designs, trademarks, or other artwork furnished to Company for
inclusion in web pages are owned by the Client, or that the
Client has permission from the rightful owner to use each of
these elements. Client agrees they are responsible for
insuring that the appropriate rights to use graphics, photos
or artwork is obtained whoever they are supplied by Client,
Company or Third Party. The Client agrees they will hold
harmless, protect, and defend the Company from any claim or
suit arising from the use of such elements furnished by
Company, Third Party or Client. Client agrees there will be
no extra charge if text for web site is supplied to Company on
disk or as an attachment via email. Text to be typed from
printed material the Client will be charged £10.00 per A4
page of text.
Client agrees there will be
no extra charges if images for web site is supplied to Company
on disk or as an attachment via email in digital format as a
jpg or gif file. Images to be scanned from a hardcopy Client
will be charged at £15.00 per scan. The quality of the image
can only be as good as the original supplied.
At the bottom of each page
of the Clients web site must carry a link to Company website.
The Client will receive 3 free
minor page updates per year for Start-Up, Bronze or Silver
packages and 6 free minor page updates for Gold package. Thereafter a fee of £20.00 will be
charged per hour or £97.00 per page. If updates are required
then reasonable notice must be given to company for the
updates to be made.
The Company will provide
the domain name and pay associated registration costs for a
full one year.
The Company reserve the
right to use examples of Clients pages for the Company own
promotional purposes. The Company also reserve the right to
use elements of any design in other web sites.
If any provision of these
terms and conditions shall be unlawful, void, or for any
reason unenforceable, then that provision shall be deemed
severable from these terms and conditions and shall not affect
the validity and enforceability of any remaining provisions.
